Attorney’s Fees

Attorneys in SSDI/SSI cases handle these matters on a contingency fee basis. These fees, however, are capped by statute. An attorney is paid the lower of twenty-five percent (25%) of a claimant’s back pay or $6,000.00. This cap on fees has not been raised since 2009. The failure of this fee cap to keep up with inflation has caused many attorneys to focus on other practice areas and has, therefore, caused a hardship on claimants who are not able to retain the services of an experienced SSDI/SSI attorney. It appears that this fee cap will finally be raised in the near future (perhaps to $7,200.00) which should result in effective legal representation to be more readily available to disabled individuals.
