We are frequently asked about a timeline for a resolution of a person’s social security disability and/or supplemental security income claim. It has been our experience that the initial and reconsideration appeal stages of adjudication are frequently taking four times longer than prior to the pandemic. This is apparently a result of massive turnover at the agency level and/or the difficulty in scheduling consultative examinations during the pandemic. The hearing level, however, has been at a much faster pace than prior to the pandemic with hearings frequently being scheduled three months after a request has been filed by our office. I know an attorney who informed me that he even had a hearing scheduled one month after the request. Your representative will need to be very proactive and work with you to prepare for the hearing in order to have a strong record for the administrative law judge to review that will result in a favorable decision.
